In these Terms, “Dr. Akita”, “we”, “us” or “our” refers to Dr. Akita. “You” means the person using the Website and/or buying products from us.

Our online store is hosted by Shopify, which provides the e-commerce platform we use to sell our products and services. Payments are processed by Shopify and/or its payment partners. We do not store your full payment card details.


2. Scope of these Terms & Agreement

These Terms & Conditions of Sale (the “Terms”) apply to:

  • Your access to and use of the Website at https://dr-akita.com (including any UK-specific pages or subpages); and
  • Any purchase you make from us through the Website or any other remote ordering method we may offer (for example, by email or phone).

By using the Website and/or purchasing from us, you:

  • Agree to be bound by these Terms;
  • Confirm that you are at least 18 years old and capable of entering into a binding contract; and
  • Accept any additional terms referenced on the Website (for example, our Privacy Policy, Cookie Policy and Returns & Refunds Policy), which form part of this agreement.

If you do not agree to these Terms in their entirety, you are not authorised to use the Website in any manner or form whatsoever.


3. Changes to these Terms and the Website

We may update these Terms from time to time, for example to reflect changes to our products, our business, or the law.

  • The latest version will always be available on this page of dr-akita.com (currently expected to be: https://dr-akita.com/policies/terms-of-service).
  • The version that applies to your order is the version in force at the time you placed that order.
  • Your continued use of the Website after we publish changes means you accept the updated Terms for any future use and purchases.

We may also change, suspend or withdraw any part of the Website (including features, content and product listings) at any time without notice. We are not liable if, for any reason, the Website is unavailable at any time or for any period.


4. Eligibility and use of the Website

By using the Website, you confirm that:

  • You are at least 18 years old; and
  • You are using the Website for personal, non-commercial purposes only.

You agree that you will not:

  • Use the Website for any unlawful or fraudulent purpose;
  • Interfere with or damage the operation of the Website (including by introducing viruses, malware, bots, scraping tools or similar harmful code);
  • Attempt to gain unauthorised access to our systems or data; or
  • Use our products or Website in a way that breaches any applicable law in the UK or in your own jurisdiction.

We may suspend or terminate your access to the Website if we reasonably believe you have breached these Terms.

You may be able to create an account on the Website to manage orders, subscription settings and contact details.

You are responsible for:

  • Keeping your login details and password confidential;
  • Restricting access to your account and devices; and
  • All activities that occur under your account.

If you believe that your account or password has been compromised, please notify us immediately at woof@dr-akita.com.

We reserve the right to disable or close accounts at our discretion where we reasonably believe there has been misuse, suspicious activity, or a breach of these Terms.


6. Our products

Dr. Akita products are designed for pets (for example, dogs and/or cats, as clearly indicated on each product) and may include:

  • Pet food and kibble
  • Treats and chews
  • Supplements and functional products
  • Other pet-care items from time to time

Key points:

  • Product descriptions, ingredients and feeding guidelines are provided on the Website and/or on the product packaging.
  • We take reasonable care to ensure this information is accurate and up to date, but minor differences can occur (for example, updated formulations, improved recipes or packaging changes).
  • Images are for illustrative purposes only; packaging, colour and appearance may vary slightly from what you see on the Website.

Always follow the instructions on the product packaging and consult your veterinarian if you have any concerns about your pet’s health or the suitability of our products.


7. Prices, taxes and promotions

Unless stated otherwise:

  • All prices shown on the Website are in Pounds Sterling (GBP); and
  • Include UK VAT where applicable.

We may change prices at any time. The price you pay is the price displayed at checkout at the time you submit your order (subject to any genuine errors we may later correct).

Additional charges:

  • Delivery charges, if applicable, will be clearly shown at checkout before you place your order.
  • Any promotional discounts, coupon codes or subscription savings will be applied at checkout if valid and correctly entered.

Promotional codes / vouchers:

  • May be subject to specific terms (for example: one use per household, minimum spend, expiry date, or exclusions);
  • Have no cash value and cannot be exchanged for cash;
  • Cannot usually be combined with other offers unless we specify otherwise; and
  • May be withdrawn or amended by us at any time, but not for orders already accepted.


8. Ordering, contract formation & availability

8.1 How to place an order

To place an order via dr-akita.com, you must:

  1. Add your chosen products to the cart;

  2. Provide accurate delivery and billing information; and

  3. Complete payment at checkout.

You can review and correct any input errors before submitting your order.

8.2 When the contract is formed

Your order is an offer to buy products from us.

  • We will acknowledge receipt of your order with an automated email. This is not acceptance.
  • A legally binding contract is formed when we send you an order confirmation email confirming that we accept your order and have taken payment, or when we dispatch the products to you - whichever happens first.

If we are unable to accept your order (for example, because a product is out of stock, there was a pricing error, we cannot verify your payment, or we reasonably suspect fraud or misuse), we will inform you and will not charge you, or we will refund you in full if payment has already been taken.

We reserve the right to:

  • Limit the quantities of any product per order, per customer or per household; or
  • Reject orders that we reasonably suspect are for resale or non-personal use.


9. Payment

We accept the payment methods displayed at checkout (for example, Visa, Mastercard, American Express, PayPal, Apple Pay or others, depending on the configuration at the time).

You must:

  • Provide current, complete and accurate payment information; and
  • Confirm that you are authorised to use the payment method you provide.

Payment is normally taken at the time you place your order. Card payments are processed securely by Shopify and/or its payment partners. For details on how your data is handled, please review our Privacy Policy and Shopify’s own documentation.

If your payment is declined or reversed after shipment, we reserve the right to:

  • Seek payment from you for any delivered goods; and
  • Recover any reasonable costs incurred in doing so.


10. Subscription orders & automatic renewals (where available)

We may offer subscription plans on selected Dr. Akita products (for example, recurring deliveries at a chosen interval).

If you choose a subscription:

  • You authorise us to take recurring payments from your chosen payment method for each renewal;
  • The price per renewal will be the subscription price shown at the time of sign-up, subject to any price changes as explained below;
  • Your subscription will continue until you cancel in accordance with this section.

Price changes for subscriptions

We may change subscription prices from time to time. If we do:

  • We will give you at least 30 days’ notice by email or via your online account; and
  • You may cancel your subscription before the new price takes effect.

If you do not cancel and continue to receive deliveries after the effective date, you will be deemed to have accepted the new subscription price.

Managing or cancelling your subscription

You can manage or cancel your subscription at any time:

  • Via your account on dr-akita.com (where this functionality is available); or
  • By emailing us at woof@dr-akita.com.

To avoid being charged for your next shipment, you must cancel before the cut-off date indicated in your subscription settings or as set out in our Subscription FAQs. If you cancel after the cut-off, the upcoming order may still be processed and dispatched.

Your statutory cancellation rights under UK consumer law (see section 12) also apply to subscription deliveries.


11. Delivery, shipping & risk

We currently deliver to addresses within the United Kingdom, unless stated otherwise on the Website.

Delivery charges and estimated delivery times will be shown at checkout. These are indicative and not guaranteed.

Key points:

  • We will use reasonable efforts to dispatch your order within the timeframes indicated.
  • Once your order is shipped, you may receive a dispatch email with tracking details (where tracking is available).
  • Delivery is completed when the products are delivered to the address you provided, or to a nominated safe place/collection point if that option was selected.

Risk and title

  • Risk in the products passes to you once they are delivered to the delivery address (or collected).
  • Ownership of the products passes to you once we have received full payment.

We are not responsible for delays caused by events outside our reasonable control (for example, strikes, extreme weather, serious transport disruptions, customs delays or other circumstances beyond our control). For further details, see section 22.


12. Your right to cancel (change of mind)

As a UK consumer, you have statutory rights to cancel a distance contract within 14 days without giving any reason. We choose to extend this to a 30-day change-of-mind period for unopened products, subject to the conditions below.

12.1 Cancellation period

You have 30 days from the date you receive the products (or the last item in a multi-item order delivered separately) to tell us that you wish to cancel.

To exercise this right, you must inform us clearly (e.g. by email) that you wish to cancel your contract.

You can use the model cancellation form in section 12.4, but you do not have to.

12.2 Effects of cancellation

If you cancel:

  • We will reimburse all payments received from you for the cancelled products, including the cost of standard delivery (but not any additional cost for premium or expedited delivery you chose).
  • We will refund you without undue delay and in any event within 30 days from the day we receive the products back, or from the day you provide evidence that you have sent them back, whichever is earlier.
  • Refunds will be made using the same payment method you used for the original transaction, unless we agree otherwise.

You must:

  • Send the products back to the returns address that we will provide to you when you contact us to cancel, without undue delay and in any event within 30 days from the day you notified us of the cancellation; and
  • Bear the direct cost of returning the products (unless the products are faulty or misdescribed - see section 14).

You are responsible for any reduction in the value of the products resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the products (for example, if packaging is opened or damaged beyond what is needed for reasonable inspection).

12.3 Exclusions

Your right to cancel does not apply to:

  • Products which are sealed for health protection or hygiene reasons (such as pet food, treats and supplements) once they have been unsealed after delivery;
  • Products which are likely to deteriorate or expire rapidly; or
  • Any other products where the right to cancel is excluded under applicable law.

Your statutory rights in relation to faulty or misdescribed products are unaffected (see section 14).

13. Returns & refunds (policy summary)

Our detailed Returns & Refunds Policy, as set out separately on dr-akita.com, forms part of these Terms and explains:

  • How to contact us to request a return;
  • When we will provide pre-paid return labels (for example, for faulty goods);
  • How refunds are processed and any timing details; and
  • Any satisfaction guarantees or “money-back guarantee” schemes that may apply to specific products.

Where there is any conflict between these Terms, our Returns & Refunds Policy and your statutory rights under UK law, your statutory rights will prevail.


14. Defective or misdescribed products

We are under a legal duty to supply products that conform with this contract.

If a product is faulty, damaged or not as described:

  1. Please contact us at woof@dr-akita.com as soon as reasonably possible with your order details, a description of the issue and supporting photos if relevant;

  2. We may ask you to return the product or, in some cases, dispose of it safely;

  3. Once we have confirmed that the product is defective or misdescribed, you may be entitled to a repair, replacement or refund in accordance with your rights under the Consumer Rights Act 2015.

If we ask you to return a faulty product, we will cover reasonable return postage costs (for example, by providing a pre-paid returns label or reimbursing agreed postage costs).


15. Promotional codes, coupons & introductory offers

From time to time, we may offer:

  • Introductory offers (for example, a discount for new customers);
  • Coupon codes (for example, “NEW15”); or
  • Other promotional campaigns.

Unless we say otherwise in the specific promotion:

  • Promotions are valid on in-stock items only;
  • They cannot be used in conjunction with other offers or discounts;
  • They are limited to one use per customer and/or per household;
  • They have no cash value and cannot be exchanged for cash; and
  • We may modify or withdraw them at any time, but not for orders already accepted.

The specific terms of each promotion (including eligibility, duration, minimum spend, and included or excluded products) will be set out on the Website or in the promotional materials.


16. Prohibited uses

In addition to other restrictions in these Terms, you must not use the Website or its content:

  • For any unlawful purpose;
  • To solicit others to perform or participate in unlawful acts;
  • To violate any applicable regulations, rules, laws or local ordinances;
  • To infringe upon or violate our intellectual property rights or the rights of others;
  • To harass, abuse, insult, harm, defame, slander, intimidate or discriminate;
  • To submit false or misleading information;
  • To upload or transmit viruses or other malicious code;
  • To collect or track the personal information of others without lawful basis;
  • To spam, phish, pharm, pretext, spider, crawl or scrape the Website; or
  • To interfere with or circumvent the security features of the Website or any related systems.

We reserve the right to terminate or suspend your use of the Website or services for violating any of the above.


17. User content, reviews & submissions

If you send us or post any content related to Dr. Akita (for example, reviews, testimonials, photos, videos, ideas, suggestions or other materials, whether on our Website, by email or via social media):

  • You confirm that you own or have permission to use that content and to grant the rights set out below;
  • You confirm that your content does not infringe any third-party rights, including copyright, trade mark, privacy or other personal or proprietary rights; and
  • You agree that your content will not contain unlawful, abusive, obscene or harmful material, or any viruses or malicious code.

By submitting such content, you grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display the content in any media for marketing, promotional or informational purposes.

We may:

  • Edit content for clarity, length, or to correct minor errors;
  • Decline to publish or remove content we consider inappropriate, misleading, offensive or otherwise unsuitable.

Testimonials and reviews reflect the opinions and personal experiences of individual customers only. Outcomes for pets may vary, and we do not guarantee that your results will be the same.


18. Intellectual property

All content on the Website, including but not limited to text, graphics, logos, icons, images, audio clips, video, data compilations and software, is owned by or licensed to Tyger Brands Hong Kong Limited and is protected by copyright, trade mark and other intellectual property laws.

You may:

  • Access and view the Website; and
  • Print or download extracts for your own personal, non-commercial use only.

You must not:

  • Copy, reproduce, modify, distribute, publish, transmit, display, perform, license, create derivative works from or exploit any part of the Website or its content for commercial purposes without our prior written consent.

Nothing in these Terms grants you any rights in or to our intellectual property other than the limited licence to use the Website for personal, non-commercial purposes.


19. Third-party tools and links

The Website may contain:

  • Links to third-party websites; and/or
  • Access to tools provided by third parties (for example, payment gateways, review platforms or subscription management tools).

We do not control or endorse third-party sites or tools and are not responsible for their content, policies or practices.

Your use of any third-party site or tool is at your own risk and subject to the terms and privacy policies of those third parties. Complaints or questions relating to third-party products or services should be directed to the relevant provider.


20. Personal data & cookies

Your submission of personal information through the Website is governed by our Privacy Policy, which explains:

  • What data we collect;
  • How and why we use, share and store it; and
  • Your rights in relation to your personal data.

Our Cookie Policy explains how we use cookies and similar technologies on dr-akita.com.

These policies form part of these Terms. Please read them carefully before using the Website or placing an order.


21. No veterinary or medical advice

Our products are designed to support the general wellbeing of pets. However:

  • Information on the Website (including FAQs, blog posts, social content and product descriptions) is provided for general information only;
  • It is not intended to constitute veterinary or medical advice, diagnosis or treatment; and
  • It should not replace professional advice from your veterinarian.

You should:

  • Consult your vet before introducing new supplements or making significant changes to your pet’s diet, especially if your pet has an existing condition, is on medication, is pregnant or nursing, very young, elderly, or has specific health needs; and
  • Stop using a product and seek veterinary advice if your pet experiences any adverse reaction.

We do not warrant that our products will achieve any specific outcome or benefit. Individual results will vary from pet to pet.


22. Our responsibility to you (limitation of liability)

We supply our products for domestic and private use. You agree not to use our products for any commercial, business or resale purpose.

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation; or
  • Any matter where it would be unlawful to exclude or limit liability.

Subject to the above:

  • We are not liable for business-related losses (including loss of profit, loss of revenue, loss of opportunity, or business interruption).
  • We are not responsible for losses that were not reasonably foreseeable at the time we entered into the contract with you.
  • We are not responsible for failures or delays caused by events outside our reasonable control, including but not limited to strikes, industrial disputes, natural disasters, serious transport or logistics disruption, acts of terrorism, war, pandemics or failures of telecommunications networks.

To the extent permitted by law, our total aggregate liability to you for any claim arising out of or in connection with your use of the Website or purchase of our products shall not exceed the higher of:

  • The total amount paid by you for the products giving rise to the claim; or

  • £100.

Your statutory rights as a consumer under UK law remain unaffected.

We will investigate and respond as soon as reasonably possible.

If we cannot resolve a dispute informally, you and we each retain the right to bring proceedings before the courts as set out in section 24.


24. Governing law & jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the laws of England and Wales.

You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. This means you may also be able to bring proceedings in your local courts if you live elsewhere in the UK.


25. Assignment

We may transfer our rights and obligations under these Terms to another organisation (for example, in connection with a restructuring, merger or sale of the business). We will ensure that any such transfer does not materially reduce your rights under these Terms.

You may not transfer your rights or obligations under these Terms without our prior written consent.


26. Severability

If any provision (or part of a provision) of these Terms is held to be unlawful, invalid or unenforceable, that provision (or part) will be deemed deleted, but this will not affect the validity and enforceability of the remaining provisions.


27. No waiver

If we delay or fail to exercise any right or remedy under these Terms, this does not mean we have waived that right or remedy, and it does not prevent us from exercising it later.


28. Entire agreement

These Terms, together with any documents and policies referenced in them (including our Privacy Policy, Cookie Policy and Returns & Refunds Policy), constitute the entire agreement between you and us regarding your use of the Website and purchase of our products.

Any prior understandings, agreements or communications (whether written or oral) are superseded by these Terms.
